Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of TrustSafeMod's services, including our website, platform, APIs, and applications (collectively, the "Services"). Please read these Terms carefully before using our Services.

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

"TrustSafeMod", "we", "us", or "our" refers to the entity providing the Services.

"User", "you", or "your" refers to any individual or entity using our Services.

"DSA" refers to the Digital Services Act (EU) 2022/2065.

"Content" refers to any data, information, or material uploaded, processed, stored, or transmitted through our Services.

3. Service Description

TrustSafeMod provides a compliance toolkit designed to help platforms adhere to DSA regulations, including notice-and-action mechanisms, content moderation tools, and reporting features.

4. Account Registration

To access certain features of our Services, you may need to register for an account. You agree to:

  • Provide accurate and complete information during registration
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized access or security breaches
  • Accept responsibility for all activities occurring under your account

5. User Responsibilities

When using our Services, you agree to:

  • Comply with all applicable laws and regulations, including the DSA
  • Not use the Services for any illegal or unauthorized purpose
  • Not attempt to interfere with or disrupt the Services or our servers
  • Not circumvent or disable any security features of the Services

6. Intellectual Property

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, icons, and software, are owned by TrustSafeMod and are protected by copyright, trademark, and other intellectual property laws.

TrustSafeMod grants you a limited, non-exclusive, non-transferable license to use our Services for their intended purpose. This license does not include the right to:

  • Modify, reproduce, or create derivative works based on our Services
  • Reverse engineer, decompile, or disassemble any portion of our Services
  • Remove any copyright, trademark, or other proprietary notices
  • Use our Services to develop competing products or services

7. Privacy

Our collection and use of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Subscription and Billing

Certain features of our Services may require a paid subscription. By subscribing to our Services, you agree to:

We reserve the right to modify our pricing with notice to our users.

These Terms will remain in effect until terminated by either you or TrustSafeMod.

You may terminate these Terms by discontinuing use of our Services and closing your account.

We may terminate or suspend your access to our Services, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

10. Disclaimers

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

While we strive to provide accurate and up-to-date information about DSA compliance requirements, we do not warrant that our Services will meet your specific compliance needs. You remain responsible for ensuring your own compliance with all applicable laws and regulations.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TRUSTSAFEMOD BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES.

12. Indemnification

You agree to defend, indemnify, and hold harmless TrustSafeMod and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice through our Services or by other means. Your continued use of the Services after such notice constitutes your acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and the laws of the country in which TrustSafeMod is established, without regard to its conflict of law provisions.

15. Dispute Resolution

Any dispute arising from these Terms shall first be resolved through good-faith negotiations. If the dispute cannot be resolved through negotiations, it shall be submitted to binding arbitration in accordance with the rules of the EU Alternative Dispute Resolution mechanism.

16. Miscellaneous

These Terms constitute the entire agreement between you and TrustSafeMod regarding your use of our Services.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.
